By accessing our website, creating an account, joining our waitlist, purchasing a VIP membership, or booking a glamping dome at Luxe Den Resorts ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Services

Luxe Den Resorts provides:

• Nordic-inspired glamping dome rentals in Lava Hot Springs, Idaho
• Wellness amenities including private mineral soaking tubs and saunas
• VIP membership program with exclusive benefits
• Waitlist registration for early access
• Related hospitality services and experiences

3. User Accounts

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. VIP Membership Program

Membership Benefits

VIP Founding Members receive exclusive benefits including priority booking, lifetime discounts, and special perks as detailed on our website.

Payment and Refunds

• One-time payment: VIP membership requires a one-time payment processed securely via Stripe.
• Fully refundable: You may request a full refund of your membership fee at any time by contacting us.

Membership Terms

• Benefits are non-transferable
• Benefits apply to the account holder only
• We reserve the right to modify benefits with 30 days notice

5. Reservation Terms

Booking Confirmation

• Reservations are confirmed upon receipt of payment
• Confirmation will be sent via email
• Prices are subject to change until booking is confirmed

Check-in and Check-out

• Standard check-in: 4:00 PM
• Standard check-out: 11:00 AM
• Early check-in or late check-out may be available upon request

Cancellation Policy

• More than 30 days before arrival: Full refund minus processing fee
• 15-30 days before arrival: 50% refund
• Less than 15 days before arrival: No refund
• No-show: Full charge applies

Modifications

Date changes are subject to availability. Rates may change for modified dates. Contact us as soon as possible if you need to modify your reservation.

6. Guest Responsibilities

House Rules

You agree to:

• Treat the property with care and respect
• Follow all posted house rules and instructions
• Not exceed the maximum occupancy for your dome
• Report any damage or maintenance issues immediately
• Leave the property in reasonable condition
• Comply with all applicable laws

Prohibited Activities

• Smoking inside domes (designated outdoor areas only)
• Unauthorized pets
• Parties or events without prior written approval
• Subletting or unauthorized guests
• Commercial photography or filming without permission
• Any illegal activities

7. Property Damage

Guest Liability

You are responsible for any damage to the property caused by you, your guests, or your pets during your stay. We reserve the right to charge your payment method for repair or replacement costs.

Damage Assessment

• Minor accidental damage (spills, broken glassware) is generally covered
• Significant damage, intentional damage, or damage from prohibited activities will be charged to the guest
• We will provide documentation of any damage charges

8. Limitation of Liability

We are not liable for:

• Weather conditions affecting your stay
• Acts of nature, including wildfires, floods, earthquakes, or storms
• Utility interruptions beyond our control
• Personal injury or property loss unless caused by our gross negligence
• Third-party services or activities

Some jurisdictions do not allow limitation of liability for certain damages, so some of the above limitations may not apply to you.

9. Assumption of Risk

By staying at Luxe Den Resorts, you acknowledge that:

• Outdoor activities (hiking, skiing, swimming, etc.) involve inherent risks
• The property is located in a mountain/wilderness environment
• Wildlife may be present in the area
• Weather conditions can change rapidly
• Hot tubs, saunas, and other amenities carry inherent risks if misused

You voluntarily assume all risks associated with outdoor activities, use of amenities, and natural terrain and conditions.

10. Indemnification

You agree to indemnify, defend, and hold harmless Luxe Den Resorts, its owners, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

• Your breach of these Terms
• Your use of the property or services
• Your violation of any law or third-party rights
• Any damage you cause to the property
• Any injury to persons caused by your actions or negligence

11. Intellectual Property

All content on our website, including text, images, logos, and design, is the property of Luxe Den Resorts and protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

12. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles.

Informal Resolution

Before filing any formal claim, you agree to contact us at hello@luxedenresorts.com to attempt informal resolution. We will work with you in good faith to resolve disputes within 30 days.

Jurisdiction

Any legal action arising from these Terms must be brought in the state or federal courts located in Valley County, Idaho.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by:

• Posting updated Terms on our website
• Email notification to registered users
• Updating the "Last updated" date

Continued use of our services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
